Waiver

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising under these Terms shall be subject to the non-exclusive jurisdiction of the courts of Johannesburg, Republic of South Africa.
Breaches of these terms and conditions
Without prejudice to Harley-Davidson Cape Town’s other rights under these Terms, if you breach these Terms in any way, Harley-Davidson Cape Town may take such action as it deems appropriate to deal with the breach, including suspending your access to this website, prohibiting you from accessing this website, blocking computers using your IP address from accessing this website, contacting your internet service provider to request that they block your access to this Website and/or bringing court proceedings against you.
Variation
Harley-Davidson Cape Town may amend these Terms from time-to-time without notice to you. Any amendments to these Terms will apply and take effect immediately at the time they are published on this website. It is your responsibility to monitor this website for any changes to these Terms to ensure you are familiar with the current version.
Severability
If a provision of these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. Entire agreement
These Terms constitute the entire agreement between you and Harley-Davidson Cape Town’s in relation to your use of this website, and supersedes all previous agreements in respect of your use of this website.
Circumstances beyond our control (force majeur clause)
Harley-Davidson Cape Town shall not be liable to you for any breach, hindrance or delay in the performance of a Contract attributable to any cause beyond its reasonable control, including without limitation any natural disaster and unavoidable incident, actions of third parties (including without limitation hackers, suppliers, governments, quasi-governmental, supra-national or local authorities), insurrection, riot, civil commotion, war, hostilities, warlike operations, national emergencies, terrorism, piracy, arrests, restraints or detainments of any competent authority, strikes or combinations or lock-out of workmen, epidemic, fire, explosion, storm, flood, drought, weather conditions, earthquake, natural disaster, accident, mechanical breakdown, third party software, failure or problems with public utility supplies (including electrical, telecoms or Internet failure), shortage of or inability to obtain supplies, materials, equipment or transportation (“Event of Force Majeure”), regardless of whether the circumstances in question could have been foreseen.
Either you or Harley-Davidson Cape Town may terminate any order forthwith by written notice to the other in the event that the Event of Force Majeure lasts for a period of 2(two) weeks or more, in which event neither you nor Harley-Davidson Cape Town shall be liable to the other by reason of such termination (other than for the refund of any goods already paid for by you and not delivered).
If Harley-Davidson Cape Town have contracted to provide identical or similar goods to more than one customer and are prevented from fully meeting its obligations to you by reason of an Event of Force Majeure, it may decide at its absolute discretion which orders it will perform and to what extent.
