DECLARATION:
I have read the Annual Charter for H.O.G. Chapters and hereby agree to abide by it as a Member of this Dealer Sponsored H.O.G. Chapter known as Table Mountain H. O.G ® Chapter (”the Chapter”). Furthermore, when signing this Membership Form manually in writing or when registering on the website of the Chapter to become a Member by the electronic submission of the Membership Form, the Member acknowledges and unconditionally agrees to all the terms and conditions set out in the By-Laws governing the affairs of the Chapter (including for the avoidance of doubt, the annexes thereto) and the Member whose application of membership has been accepted shall be bound by the By-Laws rules and regulations of the Chapter, which are then in force, of which subsequently may be altered or amended and in force at any future time (including, without limitation, the Code of Conduct). No person shall be absolved from the effect and application of the By-Laws, rules and regulations by reason of the fact that he may not have recieved a copy thereof. I further recognize that while the Chapter is chartered with H.O.G. it remains separate, independent entity solely responsible for its actions subject to the Indemnity / Waiver of Liability below.

THIS IS RELEASED - INDEMNITY / WAIVER OF LIABILITY by the Member participating or involved in whatever capacity in any event and activity conducted by the Chapter [”Even”], and when signing this Membership Form manually in writing or when registering on the website of the Chapter to become a Member by electronic submission thereof, I hereby declare, by doing so that:

1. I fully acknowledge and understand the risk and dangers inherent in motorcycling, acknowledge that I have chosen out of my own free will without any undue influence to voluntarily participate in the Event and expressly agree to assume the entire risk of my participation therein;
2. I hereby release, indemnify and hold harmless the Harley Owners Group (H.O.G.), Harley-Davidson, Inc., Harley-Davidson Motor Company, Harley- Davidson Europe, Ltd and any of its corporate affiliates as well as the Harley Davidson Sponsoring Dealer in relation to the Event, and the Chapter itself, forming part od the HARLEY OWNERS GROUP, as well as the afore-mentioned Sponsoring Dealer and Chapter’s respective officers, directors and any other member thereof participating in the Event (all hereinafter jointly and severally referred to as the “Released parties”) form:
2.1. any claims or suits which I have made or may later have relating to my person (including paralysis or death) and/or property or any costs incurred or damages suffered by me whether or not such claims, suits, costs or damages result from negligence(except gross negligence and wilful intent) on the part of any or all of the Released Parties arising from, or in connection with my participating in whatever capacity in the Event, and I assume all risks of injury and damage to my person and property arising, directly or indirectly from the conduct of the Event; or
2.2. any act or omission arising from or connection with, the conditions, qualifications, instructions, rules or procedures under which the Event is conducted by anyone of the Released Parties: or
2.3. any criminal or civil liability imposed upon a Released Party arising, directly or indirectly from any act or omission by me.
3. I UNDERSTAND THAT THE ABOVE MEANS THAT I AGREE NOT TO SUE THE “RELEASED PARTIES” FOR ANY INJURY OR RESULTING DAMAGE TO MY PERSON OR PROPERTY ARISING FROM OR IN CONNECTION WITH, THE PERFORMANCE OF ANY EVENT IN WHATEVER CAPACITY.
4. I acknowledge and consent to photographs being taken and video material recorded during the Event and furthermore that these photographs and/or video material containing image/s of me be used in HARLEY OWNERS GROUP and Harley-Davidson ® Cape Town as well as Table Mountain H.O.G. ® Chapter publicity material, such as, but not limited to, H.O.G. ® Table Mountain, Through The Grapevine Tales and the Harley-Davidson internet sites.
